Châteauguay cible les animaux dangereux plutôt que les pitbulls

(English follows) La Ville de Châteauguay va cesser d’interdire les pitbulls sur son territoire. Elle va plutôt viser les «animaux dangereux».

«Ça fait 30 ans qu’on vit mal avec le règlement qui interdit les pitbulls. Il est très difficile à appliquer. Personne ne peut dire à la vue d’un chien s’il s’agit d’un pitbull», a fait part en entrevue, jeudi, la mairesse Nathalie Simon. Elle a observé que le règlement actuel sur les animaux comportait aussi «des articles d’une autre époque comme la possibilité pour un policier d’abattre un chien à vue».

Responsabiliser les propriétaires

La mairesse a fait valoir que le virage se basait sur les recommandations de l’Association des médecins vétérinaires du Québec qui préconise de responsabiliser les propriétaires d’animaux plutôt que de cibler des races.

«On sait que le dossier est très émotif. La peur est un vecteur d’émotions. Ce n’est pas un dossier simple. On essaie d’être rationnels», a exprimé la mairesse.

Animaux dangereux

Le règlement dans les plans comprendra des mesures et amendes en fonction de trois niveaux d’agressivité, a-t-elle indiqué. Les animaux à risque pourront être encadrés sur la foi de plaintes. «Dès qu’un citoyen se sentira intimidé par un animal, il pourra porter plainte. Le propriétaire de l’animal va alors devoir le faire évaluer par un vétérinaire», a observé Nathalie Simon. Selon le cas, un maître pourrait, par exemple, avoir l’obligation de munir son chien d’une muselière en public.

Le règlement concernera tous les animaux domestiques.

«On renforce la sécurité du public. On ne la relâche pas», a plaidé Nathalie Simon.

Désaccord

Le conseiller municipal Marcel Deschamps a signifié qu’il était contre la levée de l’interdiction des pitbulls à l’assemblée publique des élus châteauguois du 10 juillet. «On n’a pas besoin de pitbulls à Châteauguay», a-t-il martelé.

Bannissement provincial possible

Le gouvernement du Québec pourrait toutefois interdire les pitbulls dans l’ensemble de la province «au moment jugé opportun», selon le projet de loi 128 déposé en avril. Si ça se concrétise, Châteauguay va l’ajouter à son règlement. «On ne pourra pas accepter les pitbulls si Québec les bannit», a confirmé Nathalie Simon.

Toutefois, le projet de loi prévoit une clause «grand-père» qui permettrait aux «propriétaires responsables possédant déjà ce type de chiens» de les garder.

Pour déterminer qui pourra bénéficier de la clause grand-père, le cas échéant, il est important que les propriétaires de chiens les inscrivent dès maintenant auprès du nouveau gestionnaire animalier «emili», a laissé entendre la mairesse. La firme est chargée par la Ville d’émettre les licences et de constituer un inventaire des chiens habitant la localité. «Nous devons savoir qui est présent sur le territoire», a dit Nathalie Simon.

Chateauguay targets « dangerous animals » instead of pitbulls

The City of Chateauguay is going to stop forbidding pitbulls on its territory. Instead, it will focus on « dangerous animals. »

«For 30 years we have lived badly with the bylaw that forbids pitbulls. It is very difficult to apply, » said Mayoress Nathalie Simon in an interview on Thursday. « Nobody can tell by a dog's appearance whether or not it is a pitbull. » She observed that the current bylaw on animals also contains « some articles from another era such as the possibility for a police officer to kill a dog on sight. « 

Making dog owners responsible

The Mayoress said that the turnabout was based on the recommendations of the Quebec Veterinary Medical Association which recommends holding the owners of animals responsible rather than blaming the breeds.

« We know that the issue is very emotional, » she expressed. « Fear is a vector of emotions. This is not a simple issue. We are trying to be rational. »

Dangerous animals

The bylaw in the works will include some measures and fines according to three levels of aggressiveness, she indicated. The animals at risk can be dealt with on the evidence of complaints. « When a citizen feels intimidated by an animal, he will be able to file a complaint, » the Mayoress said. »The owner of the animal then must have it evaluated by a veterinarian. » According to the individual case, a master could have the obligation, for example, of making his dog wear a muzzle in public.

The bylaw will apply to all domestic animals.

«We are reinforcing public safety, » Simon said. « We are not giving it any slack. »

Disagreement

City councillor Marcel Deschamps at the Chateauguay public meeting of July 10  signified that he was against the lifting of the prohibitions on pitbulls. « We don't need pitbulls in Chateauguay, » he stated emphatically.

Provincial ban possible

The government of Quebec could still forbid pitbulls all over the province « at any moment judged opportune, » according to the projected Law 128 deposited last April. If that becomes finalized, Chateauguay is going to add it to its bylaw. « We will not be able to accept pitbulls if Quebec bans them, » the Mayoress confirmed.

Nevertheless, the projected law prescribes a « grandfather clause » which would enable « responsible owners already possessing this type of dogs » to keep them.

To determine who will be able to benefit from the grandfather clause, if the case may be, it is important that dog-owners register them as early as now with the new « emili » animal management group, the Mayoress let it be known. The firm is charged by the City to issue licences and to compile an inventory of dogs living in the municipality. « We must know who is present on the territory, » the Mayoress noted.
