Châteauguay bientôt ISO anticorruption
(English follows) Châteauguay obtiendra bientôt sa certification ISO anticorruption.
Elle sera parmi les premières municipalités au Québec à joindre le mouvement, a annoncé la Ville, dans un communiqué, le 14 juillet.
«Au cours des sept dernières années, nous avons multiplié les actions afin de nous doter des meilleures pratiques de gestion, notamment dans tout notre processus d'appel d'offres et d'achat. Les initiatives mises de l'avant par notre Division approvisionnement ont même été transmises et intégrées à d'autres municipalités. Nous souhaitons aller encore plus loin afin d'assurer aux citoyens de Châteauguay une administration municipale d'une intégrité à toute épreuve», y fait part la mairesse Nathalie Simon.
Parmi les gestes posés pour «enrayer la corruption dans l’organisation», la municipalité mentionne une formation donnée aux employés cadres par l’Unité permanente anticorruption (UPAC) et «l’adoption d’un programme de formation continue aux meilleures pratiques de gestion».
«Anomalies» dans des contrats
La Ville indique dans son communiqué qu’elle a aussi procédé à «un examen des
contrats donnés par la municipalité entre 2003 et 2013, dont certaines anomalies ont été
signalées aux autorités concernées».
Quelles anomalies et quelles autorités ?
«Nous restons vagues quant à la nature des anomalies et des autorités pour respecter les enquêtes en cours. Nous pouvons certainement vous parler de deux choses qui ont été exposées, notamment lors du témoignage de Rosaire Sauriol devant la Commission Charbonneau : La short list et la composition des comités de sélection», a répondu à cette question la mairesse Nathalie Simon.
Elle a expliqué que «La short list consiste à établir une liste d'entreprises qui sont privilégiées au moment d'aller en appel d'offres sur invitation ou en contrat de gré à gré. Les comités de sélection sont formés pour étudier les soumissions où on demande un pointage. La note de passage est de 70%.»
La mairesse a précisé que la Ville avait changé ses façons de faire. «La short list a été abolie. Et en ce qui a trait aux comités de sélection, nous les avons aussi modifiés afin d'éliminer toute ambiguïté», a-t-elle fait part.
ISO 37001 – Systèmes de management anti-corruption
La norme ISO 37001 – Systèmes de management anti-corruption a été élaborée par l’Organisation internationale de normalisation. Celui-ci définit la corruption comme une «offre, promesse, don, acceptation ou sollicitation d’un avantage indu de toute valeur (financière ou non financière), directement ou indirectement, indépendamment du ou des lieux, en violation des lois applicables, pour inciter ou récompenser une personne à agir ou à ne pas agir dans le cadre de ses fonctions».
Les mesures prescrites «incluent l’adoption d’une politique de lutte contre la corruption, la désignation d’une personne chargée de superviser la conformité aux mesures anti-corruption, la formation, l’évaluation des risques de corruption et l’exercice d’un devoir de vigilance quant aux projets et aux parties associées aux activités, la mise en place de contrôles financiers et commerciaux, et l’instauration de procédures de signalement et d’enquête».

Chateauguay will soon obtain its anti-corruption ISO certification.

Among the gestures put in place to « erase corruption in the organization, » the municipality mentions training given to management employees by the permanent anti-corruption unit (UPAC) and « the adoption of a continuous training program with the best management practices. »
«Anomalies» in some contracts
The City indicates in its communique that it has also proceeded with « an examination of some contracts given out by the municipality between 2003 and 2013,
in which certain anomalies have been reported to the authorities concerned. »
What anomalies and which authorities?
« We are remaining vague regarding the nature of the anomalies and the authorities in order to respect the investigations that are taking place, » the Mayoress said. « But we can certainly talk to you about two things that have been exposed, notably during the testimony of Rosaire Sauriol at the Charbonneau Commission : The <@Ri>short list<@$p> and the composition of the selection committees, » she replied.
Simon explained that « the short list consists of establishing a list of enteprises that are privileged at the moment of going to the call for bids by invitation or by a mutual agreement contract. The selection committees are formed to study the submissions where someone asks for a points tally. The passing mark is 70%. »
The Mayoress specified that the City had changed its ways of doing things. « The
short list has been abolished. And concerning the selection committees, we have also modified them in order to eliminate all ambiguity, » she let it be known.
ISO 37001 – Anti-corruption management systems
The ISO 37001 norm – Anti-corruption management systems have been elaborated by the International Normalization Organization. It defines corruption as an « offer, promise, gift, accepting or solicitation of an unwarranted advantage of any value (financial or non-financial), directly or indirectly, independently from a place or places, in violation of the applicable laws, to incite or reward a person for acting or not acting in the context of his or her functions. »
The measures prescribed « include the adoption of a policy of fighting against corruption, the delegation of people charged with supervising the conformity to the anti-corruption measures, the training, the evaluation of risks of corruption and the exercise of a duty to vigilance regarding projects and parties associated to those activities, the putting in place of financial and commercial controls, and the institution of procedures of reporting and investigation. »
